Terms of Service

1. About these terms

These terms are an agreement between you and Atlas AiDev, Dhaka 1207, Bangladesh (“we” or “us”). They cover the AtlasAR Cloud API, the dashboard (including its Create 3D page), model hosting, and this website (together, “the service”). By creating an account, connecting a site or using an API key, you agree to them. If you use the service for a company, you confirm you can agree for that company.

The AtlasAR WordPress plugins are covered by their own licences. Purchases of AtlasAR Pro are also covered by the atlasaidev.com terms (opens in a new tab) and refund policy (opens in a new tab).

2. Your account and API keys

• Give us a real email address and keep your account details up to date.
• Keep your API keys secret. Use them from your server, never in browser code. You are responsible for all use of your keys; if one leaks, revoke it in the dashboard straight away.
• A website or app that asks to join an existing account needs the account owner's approval before it can use the service.
• You must be at least 16 years old to use the service.

3. Plans, allowances and fair use

• Free: a monthly allowance of models, a number of hosted models and a request rate limit, shown in your dashboard and on the pricing page. All free sites in one account share one allowance.
• Premium: a site becomes Premium when it has an AtlasAR Pro licence. Each site uses one of the licence's seats. Premium has no monthly model limit but keeps fair-use limits, such as how many models are made at the same time.
• Billed on success: a model counts against your allowance only when it is ready. Failed models, and models deleted before they are ready, are not counted.
• We may change allowances, limits or prices. We'll give you notice before a change that reduces what you already pay for.
• Payments for AtlasAR Pro are handled by Freemius, our licensing and payment provider.

4. Acceptable use

You may not use the service, or any model it creates, to:

• break any law, or infringe anyone's rights, including copyright, design rights and trademarks in products, photos or 3D files you don't have the right to use;
• make 3D models of real people from photos without their permission, or models meant to mislead, harass or harm anyone;
• misrepresent a product's size, look or features to shoppers;
• host or share illegal, hateful, violent or sexual content involving minors in any way;
• upload files that are meant to attack, overload or probe the service, or get around its limits or security;
• share, sell or resell your API keys or access, or use the hosting as general file storage unrelated to your products.

5. Your files and your 3D models

• You own the 3D files and photos you send, and the models we make from them. You give us permission to process your files only to make and host the models you asked for.
• We delete the file you send once its model is made (or has failed). We don't use your files or models to train AI. See our Privacy Policy.
• Hosted models are public: anyone with a model's link can view or download it, until you delete it. Don't host anything that must stay private.
• Models made on the dashboard's Create 3D page are kept for 2 hours, then deleted. Download what you need.
• You're responsible for having the rights to what you send, and for checking a model before you show it to shoppers.

6. AI-made models

Photo to 3D uses AI to guess the parts of a product the photo doesn't show. The result can differ from the real product in shape, colour or detail. Check every model before you publish it, and don't present an AI-made model as an exact scan where that matters to your customers.

7. Availability and changes

We work hard to keep the service running, but we can't promise it will always be available or error-free. We may carry out maintenance, and we may change or discontinue features. If we discontinue the service entirely, we'll give account holders reasonable notice and time to download their hosted models.

8. Suspension and ending your account

• You can stop using the service and delete your account at any time from the dashboard. Deleting it removes your hosted models.
• We may suspend or close an account, site or key that breaks these terms, puts the service or other users at risk, or is used for abuse, and remove models that break them. Where it's reasonable, we'll tell you first and give you a chance to fix the problem.

9. Disclaimers

Apart from what these terms expressly promise, the service is provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose. Optimized and generated models may contain errors; please check them before relying on them.

10. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data. Our total liability for any claim about the service is limited to the greater of the amount you paid us for the service in the 12 months before the claim, or USD 50. Nothing in these terms limits liability that cannot be limited by law.

11. Your responsibility to us

If your use of the service, or files you send, breaks these terms or the law and someone makes a claim against us because of it, you agree to cover our reasonable costs of dealing with that claim.

12. Changes to these terms

We may update these terms. We'll change the date at the top, and for important changes we'll let account holders know by email before they take effect. If you keep using the service after that, you accept the new terms.

13. Governing law

These terms are governed by the laws of Bangladesh, and disputes will be handled by the courts of Dhaka, Bangladesh, unless the law where you live gives you the right to bring a claim locally.
